By Wooden Yacht For Sale Editorial Desk
A wooden yacht title documents check in Indonesia covers the Surat Ukur, the registration deed or Grosse Akta, the history of balik nama transfers, any registered mortgage and the nationality certificate, all handled by the ship-status function at KSOP. Ownership passes by Akta Jual Beli before an Indonesian notary, then a new Grosse Akta, per Emerhub.
On a wooden boat the paperwork often lags the boat. Hulls can be altered, cabins added and engines swapped, and the documents may not follow. So your job is to compare the papers with the register, and then compare the register with the physical boat.
Which documents make up the set?
A ship-status service description from KSOP Balikpapan on the Directorate General of Sea Transportation's site covers measurement, registration, transfer of name, mortgages and nationality papers, citing PM 39/2017. We rely on it with limited verification, so have your lawyer check the current rule.
| Document | What it does | What to compare it with |
|---|---|---|
| Surat Ukur | Measurement certificate, giving tonnage and dimensions | The real boat: length, tonnage, construction, any changes |
| Registration deed / Grosse Akta | Registered ownership under the Indonesian flag | Seller's identity and the registrar's record |
| Akta balik nama | Past transfers of name | An unbroken chain to the current seller |
| Hipotek (mortgage) records | Security held by a lender | Discharge evidence, or a release at closing |
| Nationality document | The boat's national status | Its type against the boat's size and intended use |
| Safety certificates | Requirements by type, size and voyage | Expiry dates and the operation you plan |
A mismatch on the Surat Ukur is worth looking for. If the boat has been altered, the measurement data may no longer match, and that can hold up a transfer or the issue of nationality papers. Permenhub PM 2/2021 refers to nationality and registration certificates in the context of vessel administration.
Where do you verify the papers: KSOP, Syahbandar or the ship-status desk?
The local KSOP or Syahbandar is the practical point of contact. Exact authority depends on the port and the size of the boat, so ask which office holds the record for this particular vessel. It may not be the office closest to where she lies.
- Get legible copies of all documents from the seller, then see the originals.
- Ask your lawyer or notary to request confirmation from the registering office.
- Check the owner's name against the identity or company documents of the person selling.
- For a company seller, check that the signatory has authority under company documents.
- Have the Surat Ukur compared with a physical check by your surveyor.
Boatmere's warning-signs list for a purchase includes unresolved ownership documents, and it says you should not go to final acceptance until they are settled.
Why does the deed history matter for mortgages and liens?
A wooden yacht ownership check is about more than who owns the boat today. A registered mortgage can stay attached to her through a sale unless it is discharged. Ask three questions:
- Is there a mortgage on the registered record, and who holds it?
- If so, how will it be paid off, and when will the release be issued?
- Are there unregistered claims, such as unpaid yard bills, crew wages or a marina debt?
The registered record cannot answer the last one fully, so require the seller to declare debts in the contract, and ask your lawyer how Indonesian law treats these claims. Hold back the final payment until the release is in hand, using a neutral stakeholder. Our wooden yacht escrow guide explains how to tie funds to those conditions.
What do Pas Besar and Pas Kecil mean, and what could we not verify?
Whether a particular boat needs a Pas Besar, a Pas Kecil or a Surat Laut depends on tonnage, type and status. A KSOP service standard, as summarised on our wooden yacht flag and registration page, sets out tonnage bands. We could not reopen that PDF to confirm the wording, so treat them as limited verification.
Never assume every boat needs all of them, and do not rely on what a seller says the boat "normally has". Get written confirmation from KSOP or the Syahbandar, and make sure the document fits the boat's measured tonnage. Official fees follow the PNBP tariff in force on the day of service, per DJPL's technical guidance, so check the current schedule rather than an old figure.
How do the Akta Jual Beli, the notary and the new Grosse Akta fit together?
Emerhub, a commercial consultant, describes the path this way. Ownership transfers through an Akta Jual Beli before an Indonesian notary, and the buyer then obtains a Grosse Akta as evidence of ownership under the Indonesian flag. Emerhub also says survey and sea trial must come before the transfer of name for a used yacht.
A private bill of sale on its own is not the end of the matter. Change of owner has to pass through the ship-status system. Keep these points in order:
- Sign a conditional contract and place the deposit with a stakeholder.
- Finish survey, haul-out and sea trial.
- Confirm documents and clear any mortgage.
- Sign the Akta Jual Beli before the notary.
- Apply for the balik nama and receive the new deed.
Who can appear as the registered owner matters as well. Indonesian registration is open to citizens and Indonesian legal entities under the provisions we found, so a foreign buyer needs legal advice on structure before reaching this step.
How long does the transfer take?
We found no official published timeline, and we won't print one that sounds official. It depends on how complete the papers are, whether a fresh measurement is needed, the state of any mortgage, the office, and whether the boat raises import questions.
Ask KSOP or DJPL for a written estimate, and build that into the contract's dates. Remember too that the boat cannot simply sail away on the deed. Sailing approval, or SPB, depends on shipping documents, safety and crew requirements.
How should foreign buyers handle English translations?
Most of these documents will be in Indonesian. Translations are for your understanding, and the original wording is what the registrar will read. If you can't read the originals, plan for the following:
- A translation of the whole set, including the fine print on older deeds.
- A lawyer who reads the originals and reports to you, not to the seller.
- A contract that says which language prevails if versions differ.
- A check on the spelling of names across every document, since small differences can cause delay.
Once you have these, our buying guide shows where each document check falls in the wider sequence. Before you shortlist, the used boat checklist shows how to bring document gaps into your offer.
What do buyers ask about Indonesian boat papers?
Quick answers on ownership papers. This is general information from public sources and not legal advice.
What is Grosse Akta?
The Grosse Akta is the certified copy of the ship registration deed, which Emerhub describes as the buyer's evidence of ownership under the Indonesian flag. A notary or lawyer should compare it with the registrar's record and with the boat itself before any final payment.
How do I verify ownership of an Indonesian wooden boat?
Ask for originals, then confirm them at the ship-status desk of the relevant KSOP or registrar. Check the registered owner, the seller's authority to sell, any mortgage and the transfer history. Copies supplied by a broker or seller are a starting point, not a verification.
How do I transfer a boat title in Indonesia?
Emerhub describes an Akta Jual Beli signed before an Indonesian notary, after which the buyer obtains a Grosse Akta. Change of owner is then handled as a change in legal status through the ship registrar. Take advice from a licensed maritime lawyer on your specific boat.
How long does an Indonesian boat title transfer take?
We found no official timeline. It depends on the completeness of the documents, any measurement or inspection, mortgages, the office involved and any import questions. Ask KSOP or DJPL for a written estimate before you fix a closing date.
Can a boat sail on the strength of a sale deed alone?
No. Sailing approval depends on shipping, safety and crew requirements as well. A sale deed does not by itself give the port authority what it needs to issue a Surat Persetujuan Berlayar, so check all the operating papers as well as the ownership ones.
